www.monojuice.ch is an online store of Manufaktur Gassmann GmbH (hereinafter MGG). The products of MGG are only shipped within Switzerland.

The present General Terms and Conditions (hereinafter GTCs) determine the rules for the use of this homepage (www.monojuice.ch) and apply to all services of MGG. MGG may amend the GTCs at any time. Such amendments will come into force at the time of publication.

1) Order
Orders can be placed with or without prior registration.

By clicking the button "buy" in the online store monojuice.ch you place a binding order of the goods contained in the shopping cart. The receipt of the order will be confirmed to the customer immediately by MGG electronically. A contract between you and MGG is only concluded as soon as MGG expressly accepts the order. MGG reserves the right to refuse the conclusion of a contract without giving reasons.

All orders placed before 12 noon will be handed over to the Swiss postal service on the same day and should therefore reach the customer on the following day (provided it is a working day).


2) Delivery & place of performance
MGG sends all its packages A-Post with the Swiss Post. The Swiss Post guarantees with the A-Post dispatch (12.50 CHF) a delivery of the package at the latest on the following working day of the order entrance. The place of performance is the place of delivery to Swiss Post. The customer bears the risk for the transport of the goods from the place of performance.

3) Conclusion of contract & cancellation
To avoid chaos, we only accept your orders via our online shop. After you have filled your shopping basket with our delicacies, you order its contents by paying by credit card. By placing your order, you confirm that all the information you have provided is correct. You will then receive a confirmation email. There is no right to a refund for incorrectly ordered products. 

4) Acceptance & transfer of benefit and risk
It is your responsibility to ensure that our delivery to you is personally received by someone at the delivery address on the delivery date. When the package is handed over to the post office, the benefit and risk, in particular the risk of theft, damage by third parties and environmental influences, pass to you. We guarantee to maintain the cold chain until the goods are handed over or deposited at your delivery address. From this moment on, you are responsible for the proper storage and cooling.

Please check the delivery immediately after receipt for completeness and correctness and let us know immediately if anything is wrong. If we do not hear from you on the day of delivery, we assume that the ordered service has been provided by us.

5) Prices
All prices on www.monojuice.ch include the legal value added tax of 2.6%. All amounts are in Swiss francs. The prices which are displayed on www.monojuice.ch at the time of the order are decisive. The shipping costs are shown separately in the order process and are charged to the customer.

6) Empties
Please make sure that the PET bottles are recycled. Of course you may reuse the bottles for your private purposes.

7) Company holidays
We reserve the right to interrupt production during company holidays. Any company holidays will be communicated by newsletter. Current subscriptions will be interrupted for this period and continued after the interruption.

8) Liability
If the Customer is a consumer, MGG's liability in the event of a slightly negligent breach of duty is limited to the direct average damage that is foreseeable and typical for the type of goods. This also applies in the event of a slightly negligent breach of duty by MGG's employees, workers, representatives or vicarious agents.

If the Customer is an entrepreneur, a legal entity under public law or a special fund under public law, claims for damages are excluded irrespective of the type of breach of duty, including tortious acts, except in cases of intent or gross negligence. In the event of a breach of material contractual obligations, MGG shall be liable for any negligence, however, only up to the amount of the foreseeable damage. Claims for loss of profit, saved expenses, from claims for damages by third parties as well as for other indirect and consequential damages cannot be demanded.

To the extent that MGG's liability is excluded or limited, this shall also apply to MGG's employees, representatives and vicarious agents.

The limitations and exclusions of liability set out under the heading "Liability" do not apply to claims arising from fraudulent conduct on the part of MGG, or in the case of liability for guaranteed characteristics, claims under the Product Liability Act or damages arising from injury to life, limb or health.

9) Security & data protection
Your order data will be stored by us, but cannot be accessed directly by us for security reasons. You undertake to treat your access data confidentially and not to make it accessible to unauthorised third parties. We cannot accept any liability for misused passwords.

Unfortunately, the transmission of data via the Internet is not completely secure. Although we take reasonable measures to protect your information, we cannot guarantee the security of the data. Any transmission of data is at your own risk.

10) Guarantee of data communication
Data communication via the Internet cannot be guaranteed to be error-free and/or available at all times given the current state of technology. MGG is therefore not liable for the constant and uninterrupted availability of our online shop nor for technical and electronic errors during a sales transaction, in particular not for the delayed processing or acceptance of orders.

11) Product declaration
Product information such as ingredients is updated regularly. Since recipes can be changed at any time, we recommend that you also regularly consult the list of ingredients on the packaging and pay attention to any allergy information.

12) Nutrition and health information
Although we provide general information about health, detoxification and nutrition on our website and in other information material, this is not to be equated with medical advice and is not designed to meet your specific personal requirements. This information does not purport to be complete or accurate and is in no way a substitute for medical or pharmaceutical advice from a medical practitioner. No liability is accepted for damages of any kind arising directly or indirectly from the application or use of the information. Please read all product inserts and dosage recommendations carefully and consult your doctor or a specialist if you have any questions about use and mode of action.

We manufacture our shots in a production facility where nuts are also processed. It is therefore not possible to rule out the possibility that traces of nuts may be present even in apparently nut-free dishes. By ordering from us, you acknowledge that we cannot be held responsible for any reactions to nuts or any other ingredient.

The contents of this website (including all text, graphics, illustrations, photographs, animations) are subject to copyright. It is not permitted to use them without our express written permission.

14) Severability clause
If any part of these GTC is found to be unenforceable or invalid for any reason, the validity of the remaining provisions shall not be affected.

15) Applicable law & place of jurisdiction
The contractual relationship shall be governed by Swiss law to the exclusion of the UN Convention on Contracts for the International Sale of Goods. The place of jurisdiction for natural persons is Zurich or at the customer's place of residence. For legal entities, Zurich shall be the exclusive place of jurisdiction.
